MERCOSUR and Front-of-Pack Labeling: Legal Arguments to Preserve Argentina’s Protection Standards

The Healthy Eating Promotion Law is currently at risk due to the MERCOSUR front-of-pack labeling harmonization process, which threatens to weaken the protection standards achieved in Argentina. This document provides concrete legal tools and arguments for those defending the human rights to health and adequate food. The analysis reviews the constitutional and international principles that require the Argentine State to uphold the current level of protection and examines the compatibility of the octagonal warning label system with international trade law. A technical resource to challenge, on every level, any regulatory rollback

The Right to Food in Argentina: Implications and Challenges of the Healthy Eating Promotion Law in the Context of Emergency Food Policies

Despite the constitutional recognition of the right to adequate food in 1994, food insecurity and the logic of emergency-based responses have shaped Argentina’s food policy over the last decades. This report analyzes that process from a human rights perspective, reviewing the main regulations and policies between 2002 and 2025. It examines the tensions between the prevailing assistance-based model and the State’s obligations under international human rights law, and presents the Healthy Eating Promotion Law (Law No. 27,642) as the most significant paradigm shift in this field in the last two decades. In a context marked by regulatory setbacks and worsening food insecurity, the document identifies current challenges for the effective implementation of the right to food and outlines possible paths for its protection and enforceability.

Fundeps, in partnership with UNICEF Argentina, developed this technical document that brings together regulatory tools and practical recommendations to help local governments promote sustainable public policies that improve the habits and nutrition of children and adolescents. It is a resource designed to support municipalities in creating healthier environments with access to safe water, adequate food options, recreational spaces, physical activity, and breastfeeding support, among other key measures.

Marketing of substitutes and rights at risk

This report seeks to reflect on the scope and limitations of breastfeeding protection policies in Argentina, with an emphasis on regulatory acceptance and the effectiveness of their implementation. It begins by analyzing the international human rights regulatory framework that promotes and guarantees the protection of breastfeeding and the importance of the International Code of Marketing of Breast-milk Substitutes (ICMSM) and subsequent World Health Assembly (WHA) resolutions as a tool to guarantee adequate and effective protection of the rights to food, health, and information of children, women, and pregnant people. It then analyzes, from a human rights perspective, the findings of the monitoring carried out by the ObservaMaS platform, which reflects the worrying noncompliance with national and international regulations and the advancement of the marketing strategies of the breast-milk substitutes industry.

This report aims to contextualize the problem of smoking and analyze its multiple impacts on health, the environment, the economy and society, from a comprehensive, relational and intersectional perspective. Based on an exhaustive review of the literature and scientific evidence from sources without conflicts of interest, this work focuses on the specific effects of tobacco consumption and the activities of the tobacco industry in Argentina and the region.

Social representations of youth, adolescents and children on the different types of tobacco and nicotine product consumption

From Fundeps we conducted a study interviewing youth, adolescents and children from different socioeconomic levels, to comprehensively understand the consumption of tobacco products and generate evidence regarding the profile of consumers and the context surrounding their consumption.

In this report you can find reasons, beliefs, experiences, expectations, emotions and motivations, related to tobacco consumption; and considerations about the people who consume it, taking into account factors such as gender, age, socioeconomic level and school and extracurricular activities.

Food industry interference – Report

Food and beverage industry interference is defined as influencing legal frameworks and policy environments in order to delay, weaken or prevent the development of healthy eating policies. These companies and groups related to their interests carry out different actions to intervene in the development of public policies and to influence the academic world and science.

This report seeks to document the case of interference by the food industry in Argentina, within the framework of the debate and sanction of the Law for the Promotion of Healthy Eating (No. 27,642), better known as the Labeling Law, as well as the initiatives developed by civil society to counteract this interference.

This report, carried out with the financial support of the Global Health Advocacy Incubator (GHAI), compiles the views of five civil society organizations that actively and jointly participated in the promotion of the law, and currently continue working towards its correct implementation: the Inter-American Heart Foundation Argentina (FIC Argentina), Consciente Colectivo, the Foundation for the Development of Sustainable Policies (FUNDEPS), the Foundation
SANAR and the Argentine Federation of Nutrition Graduates (FAGRAN). These organizations, free of conflict of interest, began working together in 2021 and provided scientific evidence to justify the choice of labeling. In addition, they carried out advocacy actions with different political decision-makers during all the years in which the policy was debated, and carried out communication campaigns to inform and support the approval of the law.

Este viernes 31 de julio realizamos un nuevo encue Este viernes 31 de julio realizamos un nuevo encuentro de formación en derechos sexuales y (no) reproductivos. 

En articulación con el Consultorio de Salud Integral y con el aval de la DAJA, compartimos la jornada de capacitación con profesionales del Hospital Vicente Agüero de Jesús María.

Más de 15 profesionales de diversas disciplinas se dieron cita, para conocer diferentes aspectos de la práctica de AMEU y fortalecer su trabajo diario, en pos del acceso al aborto legal, seguro y gratuito.

Como en cada instancia, celebramos el compromiso de cada participante y agradecemos especialmente a la Dra. Kenia Torres y al Director del Hospital, Dr. Javier Díaz, por la predisposición para recibirnos.

🌎 Hace un año, la @corteidhoficial emitió su histó 🌎 Hace un año, la @corteidhoficial emitió su histórica Opinión Consultiva sobre la emergencia climática.

✊ Una victoria para quienes defienden el ambiente en América Latina y el Caribe: la Corte confirmó que proteger a las personas defensoras del ambiente no es opcional. Es una obligación legal.

⚖️ Para explicar qué exige esa protección, la Corte se apoyó en el Acuerdo de Escazú. Resultado: la gran mayoría de Estados de América Latina y el Caribe no pueden ignorar los estándares de Escazú, incluso si aún no han ratificado el tratado.

🔎 La implicación es clara: los países de la región deben fortalecer el acceso a la información, la participación pública, la justicia ambiental y la protección de quienes defienden el ambiente. 

📝 La Opinión abre nuevas rutas para frenar la criminalización de personas defensoras, responder a las restricciones al espacio cívico y defender la participación pública en países como Costa Rica, Guatemala y Perú. Compartimos el análisis de  @manizalmigrante del @ciel_org

📣 La discusión ya no es si los países de América Latina y el Caribe deben proteger a quienes defienden el ambiente. Eso ya está claro. Ahora hay que usar la Opinión: en tribunales, reformas, debates públicos y procesos de movilización para exigir mejores garantías y mayor protección.
